2. 41 games is way too harsh for someone who violated rules but did not bet on hockey. I think 25 games is more appropriate for something like this.

Players getting suspended for off-ice issues don't count towards the cap. The Sens could have signed him right now, have him serve the suspension with no cap hit, and have him back in the 2nd half of the season with a much lower cap hit.

How do you count games towards a suspension when the player never had an NHL contract? He couldn't play those games if he wanted to, it's no different than suspending an injured player retroactively.
