Simple

Thats the way legal proceedings are always handled. Legal proceeding are never talked about during the process. Thats just the way it is and for many reasons
 
I’m not totally comfortable with the idea that the Leafs said they weren’t going to comment further the night of the leak, but then Dubas came out after and spoke at length about it.

That said, it felt like what he said was the right tone. Disappointment and teachable moment as opposed to like the catastrophic end of the relationship.
 
I don't agree. Matthews' lawyer(s) is Matthews' advocate. MLSE's lawyers are MLSE's advocates. In many ways I'm sure their interests intersect but in other ways they don't intersect at all.

If anyone gets in a personal criminal legal kerfuffle, should they go to their employer's Human Resources dept to get access/recommendation to a lawyer or find one on their own and not involve their employer in any way? If you think the former is a good idea, you may be hopelessly naive and don't know how the legal system works.
I think anyone who has a morality clause in their contract is obligated to inform their employer of behavior that puts the company's image in question.

... maybe Matthews did inform the organization, but they held it under wraps. When they determined the captain wouldn't be Matthews, knowing that it would cause a stir from the fanbase, they allowed the story to get out so that it wouldn't have such an ordeal when it wasn't Matthews they chose.

I don't think it's the right approach. Matthews' needs to feel the heat from the public to really know how much he screwed up. Dubas not covering it up is a strong message that Matthews' effed up in not telling the organization about it.

Matthews is on his own here to wear this. Had he told the Leafs about it, I imagine Dubas would have his back a little more.

Ultimately there's no clear cut evidence of what the right/wrong approach is here .. Really it's just about ensuring that Matthews can grow from this and we can move on.

This will blow over once the puck drops next week and the games start to count

Looking at the big picture, I could see this being a good wake up call for Auston Matthews who has been riding high as the poster boy for the Leafs and NHL, is getting paid a fortune and everyone wants to hand him the keys to the kingdom. Just a reminder of the responsibility he has to himself and all the other commitments that follow. Do you want to be the guy we think you can be? Well, now he’ll have a better understanding of that real responsibility and hopefully he lives up to it.

In terms of the captaincy let’s not forget he’s the second youngest guy likely on the Leafs behind Sandin. So maybe we’ve all been trying to give him too much too soon.
I know that EDM and COL are extreme examples but I can't think of an example of where giving the C to a young player has worked and resulted in a cup winning or true contending team.

Edit: Toews. I guess that the caveats being that he had leadership support from the back end and he is an exceptional leader in his own right.

Just about the same time the media gets a hold of, and releases, the video showing Matthews stumbling around with his pants down to his ankles :thumbu:

Yeah. It's much more forgivable if he immediately owns up to it, especially because the Leafs can use their lawyers and public relations capabilities to handle the situation as well as possible, with time to think about it.

Now its just kinda slapped down for everyone to see. And worse, it could make you wonder if he purposefully kept it secret in hopes of being named captain before this comes to light, which would be... questionable at best and nefarious at worst.

Probably kept it from a lot of people.

Just horrible judgement from a young guy. A big learning experience for sure.

sorry. i'm not going to blame Dubas for responding truthfully for Matthew's dumbness.
 
Lawyers are not allowed to have a conflict of interest. The lawyer employed by MLSE has a conflict of interest in representing Auston Matthews as his sworn loyalty is to the MLSE corporation before anything else. A lawyer can represent MLSE OR Matthews, not both, because their interests are different. That's just a basic thing.
Perhaps I misunderstood your point.

I thought you were suggesting that it was fine for Matthews to not inform the Leafs of the situation.
 
Pro athletes' representation should be less cooperative about the control and oversight the teams and leagues believe they have over the athletes. It's odd how many get their hackles up over the imposition of superficial rules about facial hair and clothing but have no issue over the assumption that every personal misstep away from the game is the team's business.
 
I think this hit Dubie like a ton of bricks. We will see in next week but it is my understanding that Dubie was in the Matty camp which is why I voted Matty even though I thought Rielly would be best captain. I would bet Dubie reconsidered his opinion after this incident.

That said -as Burke literally said the other day on the radio -teams (including MLSE) literally keep former and active law enforcement personnel on retainer as "fixers"to make things like this go away/stay out of the press.

While I also don't think Matthews is obligated to talk to the Leafs about anything to do with this (in principle), I was saying Matthews' representation (his criminal lawyers for sure, probably also his hockey agency) knew about this incident and would have advised him on what actions to take. The fact that he didn't contact the Leafs means their legal advice was in direct conflict with even discussing the issue with MLSE.

Criminal defense lawyers have "fixers" too. Fixers who operate out of the state where the criminal case took place.

I think questioning the legal service Matthews got is definitely something to consider. Unless Matthews ignored legal advice or never sought it until recently.

This has been a best possible outcome for Auston Matthews the human being. What lesson would Matthews have learned if one of these fixers had made this go away completely. A little bit of public shame for being jackass seems entirely appropriate punishment. And no the incident still seems super minor but it'll be good that he has to make up for it rather than only laugh it off as something he got away with.
