I can't see the reasoning where a professional hockey team could be "confused" with insulated beverage containers.

We live in a world where companies slap their brands on almost everything. I have an NHL team-branded cup in my kitchen, and I'm sure Yeti probably sells shirts and hoodies with their logo on the front. There is likely much more overlap in terms of branded paraphernalia than most would think

As an IP attorney in the US, it's hilarious how many of you are commenting as if you have even the slightest grasp on trademark law or how the USPTO works. The YETI application was refused because the HC is seeking to register the mark for clothing and other merch-related items for which there are already registered YETI marks. It's not because the government thinks people would be confused between YETI being used for the provision of hockey exhibitions and YETI being used for coolers and insulated cups.

When the YETI name was first floated, there were several articles pointing out that it would be a difficult path to register the YETI mark because of the existing registrations, which the HC was aware of. The HC is free to try to negotiate consent or coexistence agreements with the owners of the existing YETI registrations (which I'm sure they have tried), but it appears those holders of the existing regs aren't willing to play ball (or puck). Trust me--both the NHL and the USPTO have very smart attorneys handling these matters.

It's unique until new expansion teams do the same thing. Can they trademark "hockey club"? I also think "soccer club" and/or "hockey club" should only be used when the team is owned by the city.

not from what I see and HC was temporary because of the late transfer of the franchise SC/HC aren't, and this case, not owned by the city.... hence why SLC isn't being used .... this isn't a true expansion franchise either.... it's a relocated franchise....

I finally remembered where I saw the Yeti name very visable for a sports team. I knew there was a crossover since I saw this news but I couldn’t actually pin point where.

Austin’s MLS team is basically called the Yeti based on their jersey advertisement place/size without officially being called the Yeti

Utah Hockey Club isn't even a name for a team? It's like Finland national team, or Canada national team, or whatever. Utah hockey club, New york hockey club, Florida hockey club, etc.

It would be a massive issue if you could trademark such a name.

The Saskatchewan Roughriders and Ottawa Rough Riders technically had 2 distinct names, the space between "Rough" and "Riders" by Ottawa's team is what defined that.

Lots of other sports have done it in their respective top-level leagues, however temporarily or permanently, especially in Europe. Think there's plenty of (place name) HC or FC. Washington Football Team existed for a season or two.
