Case in point: Bob Menendez (D-N.J.)'s co-defendant wife (then GF) hit and killed a pedestrian in 2018. The cops ended up letting her go without a sobriety test because supposedly the pedestrian was jaywalking:

Well that’s just idiocy on the part of the cops.
Yes, the test for manslaughter is higher than say, reckless endangerment, which only requires the common sense test that the person in question should have reasonable concluded his/her actions would increase the risk of harm.
That said, somebody racing at 120mph past a school zone that hits a kid is absolutely going to get charged with manslaughter. Whether thats the charge the sticks or he pleads down is up to the prosecution.
Back to the discussion though, I dont know or even have an opinion on whether the incident merits charges. I simply want an investigation. If it comes up empty, so be it, at least due diligence was done. I hate the notion that ‘it happened during a hockey game’ is an automatic get out of jail free card for dangerous or malicious behaviour that falls well outside the realm of accepted risk when playing a sport.
Again, not saying that happened here, just very open to investigations done on a case by case basis.
