People keep saying that. What, exactly, is the precedent being set? Because it's a remarkably goofy situation at just face value, never mind what's behind the scenes that we may NEVER be privy to.

Richards should have been smarter, he obviously knew he had the worst contract in the NHL and the Kings would be looking at any way to get out of it. He shouldn't have crossed the border with illegal drugs.
You just robbed the Kings of $14 million the previous two seasons, pay one of Cris Carter's "fall guys" to carry the drugs over the border for you if you need them that bad.
So when do we find out about the cap recapture penalties? Is it going to be the 10 year hit or something lesser because of the potential outcome of this?
If there is a settlement, I imagine it would be the $1.32m/5 yrs.
The reason being that a settlement would essentially drop the NHLPA's grievance (i.e. as though MR had never filed one) reverting the situation to the terminated contract with the recapture penalty in place.

The money side of things is probably always negotiable, as that is more between the Kings and MR. MR however is not negotiating cap space, and the resolution of that is a completely different matter, and deviation from the CBA could make 29 other teams upset. If this isn't resolved, the arbitration hearing will have a clear winner, and the CBA will be interpreted and implemented. I truly believe the settlement of money between the Kings and MR is the easy part. The cap part, what 29 other teams are thinking, what the PA is thinking, that's the hard part.If that happens, all the rules lawyers in the Main and Business of Hockey boards are gonna **** and fall back in it. "Where does it say that in the CBA?!!!" they'll stammer. "Show me the clause." There is only one clause that matters: Everything is negotiable. Always.

The cap hit will be the $1.32 million plus whatever is settled upon by the Kings and Richards.

Now, is that over a course of 5 years for the cash basis? 10? If the settlement is say 5 million cashout, would the cap not be 2.32 over 5 years? If the payout is 10 mil, wouldn't the hit be 3.32? Seems pretty stiff, unless the payout is relatively small.
And does it come out of the players share? I am sure all the players in the league would like a pay cut so Mike can get some money.Good question and wow- did anybody think that the cap hit would be calculated on that basis, if it indeed comes to pass? So, if Richards gets $10 million over the next 5 or 10 years (he'd want 5), then the cap hit would be 1.32 + 2.0 (3.32) over each of the next 5 years or 1.32 + 1.0 (2.32) over each of the next 5 years and 1.00 over the following 5 years respectively.
It's an easy fix.... settlement = $0, then employ him as an overpaid "scout"... the Pronger deal has shown it's possible for a "player" (receiving an LTIR) salary to also work as a scout. The precedence is already set.
