The actual settlement to pay MR might never be known, but how the cap will be managed will be public.
 
Man, I give Lombardi credit if he gets a reduction in the buy-out cost and the cap penalty when this is all done. I can't believe the PA would support this given the precedence.

Good to hear Richie is gonna get at least some money. I love the guy and I don't think it's necessarily his fault that his body gave up on him.. He just played the game so hard compared to his build and it wore on him quick and he was never the same after that concussion against the Hawks. I never would say it didn't seem like he wasn't working hard out there.

I still don't think we know everything. If this case was going to be such a slam dunk for the NHLPA with the Kings having no hope of showing a material breach of the contract on Richards part, then the NHLPA wouldn't settle.

Richards should have been smarter, he obviously knew he had the worst contract in the NHL and the Kings would be looking at any way to get out of it. He shouldn't have crossed the border with illegal drugs.

You just robbed the Kings of $14 million the previous two seasons, pay one of Cris Carter's "fall guys" to carry the drugs over the border for you if you need them that bad.

They are using the wrong word. It's not "precedence" because it's not a court of law.

The NHLPA would be concerned, if at all, as a reference point. But every player and situation is different, so realistically they aren't too concerned in all likelihood.
 
being involved in risk management in my new position they always weigh the overall costs of everything possible in making decisions and if they can settle for a guaranteed number that is for sure it would be better than possibly saving even a bigger number just in case they lose and for mike it would be better because if this is prolonged and there is the legal fight we all know is coming even if he wins the legal costs will eat a large part of his money, even if the PA is in the lead on it he would still garner large legal costs just protecting his interest and even with the govt. case might go easier without the public eye being on him

It may be there's more to it [which there probably is] and they feel they can't be 100 percent certain they'll win. A settlement agreement by both sides would give everyone a winning feeling and put this finally to rest.

That speech was hilarious and down right shocking to hear from a guy being paid by the NFL to speak to rookies about being a pro. "you want to be in my crew, you're the driver if I get pulled over for anything"
 
There's always risk of it going south either for Richards or for the Kings. A settlement removes the uncertainty and keeps things confidential.
 
So when do we find out about the cap recapture penalties? Is it going to be the 10 year hit or something lesser because of the potential outcome of this?

If there is a settlement, I imagine it would be the $1.32m/5 yrs.

The reason being that a settlement would essentially drop the NHLPA's grievance (i.e. as though MR had never filed one) reverting the situation to the terminated contract with the recapture penalty in place.

If that happens, all the rules lawyers in the Main and Business of Hockey boards are gonna **** and fall back in it. "Where does it say that in the CBA?!!!" they'll stammer. "Show me the clause." There is only one clause that matters: Everything is negotiable. Always.

I guess that makes sense. Mike's camp probably doesn't want to run the risk of getting zero so they'd take some smaller lump some and say fine, terminate the contract. I guess we'll find out soon enough, but cap certainty would be nice when dealing with Kopitar's extension.

The money side of things is probably always negotiable, as that is more between the Kings and MR. MR however is not negotiating cap space, and the resolution of that is a completely different matter, and deviation from the CBA could make 29 other teams upset. If this isn't resolved, the arbitration hearing will have a clear winner, and the CBA will be interpreted and implemented. I truly believe the settlement of money between the Kings and MR is the easy part. The cap part, what 29 other teams are thinking, what the PA is thinking, that's the hard part.

Now, is that over a course of 5 years for the cash basis? 10? If the settlement is say 5 million cashout, would the cap not be 2.32 over 5 years? If the payout is 10 mil, wouldn't the hit be 3.32? Seems pretty stiff, unless the payout is relatively small.

It's an easy fix.... settlement = $0, then employ him as an overpaid "scout"... the Pronger deal has shown it's possible for a "player" (receiving an LTIR) salary to also work as a scout. The precedence is already set.
 
If the settlement adheres to the CBA policy, the buyout is over twice the length of the remaining contract. So if he had 5 years left, it's 10 years.

A settlement of $10M would likely be $1M per year plus recapture.
