It's not civil at all, it occurs by virtue of section 810 of the criminal code.

Criminal Code

If injury or damage feared

  • 810 (1) An information may be laid before a justice by or on behalf of any person who fears on reasonable grounds that another person
    • (a) will cause personal injury to him or her or to his or her spouse or common-law partner or child or will damage his or her property; or
    • (b) will commit an offence under section 162.1.

It's common in domestic violence situations and similar where someone hasn't actually crossed the line into criminal territory yet, but you fear they may. You can be awarded the peace bond and then if the person violates any of the conditions, they can be charged with an offence for violating the condition of the peace bond.

So when will the police assist in an instance of cyber harassment? You suggested it is relevant in this case.

Domestic violence situations are completely distinct.

You know it's easy to be a jerk about this as a habs fan(to an extent, we suck) but really...I feel bad for everyone involved. What a disaster and as human beings it really sucks for Karlsson and his wife to be harassed.

I guess we won't know if it's Hoffman's wife until it's proven but regardless whoever it is doing that is a jerk.

Hoffman’s agent also expressed his confidence in Caryk’s innocence and told this newspaper Hoffman only learned of Melinda Karlsson’s application from the news report.

“It’s a very delicate and difficult situation,” Hooper said. “At this stage, we haven’t been provided anything at this point in time that would indicate Mike or Monika is involved with this type of situation.”

Hooper expressed some frustration and disappointment with only having “Mike and our side” finding out about the order of protection application from the media and not the police.

“I think this has been between Melinda and Monika and less between Mike and Erik,”

It appears by the timeline here the friction/problems surfaced within the team before the application. That Hoffman's agent says that he and Dorion were aware of the situation since the end of the season and Hoffman only became aware of the application from the media recently.

Not saying it would be easy but with actions and posts like hers it be very hard to support her and stay with her. I don`t think Hoffman would struggle to find a new one

I just came on to try and get some of the gossip and saw this. I am wracking my brain but I was on a flight from Toronto to Phoenix a couple weeks ago for May 2-4 of Sens and a bunch of Sens and friends were on the plane with us for what I am 95% sure was Hoffman's stag that weekend... So unless he got caught by said gf with a bunch of girls while at the W Hotel in Scottsdale (where we also were) then I don't think he is gonna be breaking up with here soon.

Feel for you guys. What a shitshow.

Well its finally out. Was hoping it would happen after they were both traded. Now their trade value takes another hit, being a fan of this team is terrible.

Literally nothing good comes of this for anyone. They better give up their first to Colorado because they are finishing dead last.
How would it affect EK’s value though? Hoffman I can understand

Sadly, this is the social media world we live in which includes all the misfits & malcontents with an ax to grind against anyone & everyone behind the cowardness & anonymity of their keyboard. I assume it's possible that somehow their accounts were hacked & their name misappropriated, but if it was done on purpose & Hoffman knew about it, one would have to think that Hoffman's future is in jeopardy & not just with the Sens but in the NHL.

He could be blackballed & if no one wants him then what does Ottawa do with an asset they can't trade & can't play if the players on this team or any team don't want him on the team either. What a mess, I just hope it's proven they were hacked & it isn't a crazy GF story. I guess Hoffman isn't the first or won't be the last athlete to get involved with a crazy person, if proven, hopefully, he didn't know anything about it or else he is done. So much crazy crap going on these days with this team & the world at large.

So apparently Hoffman is going to be completely cooperative in the investigation. What happens if it actually wasn’t his wife???

After all EK and his wife have been through, I would not be surprised if they would like to move on from Ottawa for a fresh start elsewhere. I certainly hope that is not the case but am sure is something they will be considering regardless of the outcome of this situation.

Just dropped into say sorry for the shizzle-show that has been your season and offseason, and hope it passes soon, and for good. Always been a Sens and OTT fan but this is wrong wrong wrong. Jeebus.

The reporter who broke the story said on TSN1200 they tried and failed to serve Hoffman's GF. They don't know why they weren't able to serve a summons to her, so it could be for a number of reasons, but at this point apparently the Karlsson's would have to decide if they want to apply again to have her served, or go another route (which she didn't really elaborate on).

Right, the rules of civil procedure allow for alternatives to service if you can show that you tried them at X, Y, Z addresses etc. Sometimes they will allow you to send an email with the notice, there was even a recent case where the parties used instagram to serve someone.

I'm just giving you an example of how these are usually used. There's nothing inherently different about a cyber-stalker harassing their ex-partner online vs a cyber-stalker harassing an ex-friend or even a stranger. Usually in a situation like this the parties will have gone to the police, which from the Citizen article seems like this has happened, and then the police will evaluate and see if they want to bring charges, file for a peace bond, give a warning, etc.

I'm explaining that they didn't have the assistance of the police in this case because if they did the court documents would have shown this.

If the defendant does not consent to the peace bond, the police will swear the Information before the Court, and a hearing date will be set. The Court will then issue a summons for the defendant to appear on that date.
