Here's hoping we keep Kadri if it comes to decertification.

This actually brings up a valid point. I wonder what type of salary some of the recent draftees would be looking at. Yak, Rielly, Oilers' kids etc. Certainly considerably more than what they're getting on ELC now. I can see some huge mistakes being made by GMs should it come to dissolving the union.
 
I'm sorry but we didn't win a cup in the previous 50 years that we could out spend the opposition - what makes you think its gonna work this time around?

Still its quite sad that this franchise can't even compete when the playing field is levelled. Perhaps we should lobby for a new rule that visiting teams may only dress 4 defensemen when playing The Maple Leafs at home?

Its very pathetic this franchise tbh, however if decertification does happen the leafs are the leading revenue generator and if this team doesn't ice a good team then, u might as well piss away your fans cause the nhl lockout(sss) have pissed everyone else off enough, myself as a huge leaf fan would be very angry if we didn't flex our financial muscle.
 
Seeing as most would go back to their hometown teams, Leafs will be a cup winner. Somebody post a lineup with all GTA/Toronto players? And in 2 years if he doesn't decide to go to Pittsburgh, McDavid:D

What would happen in an event of decertification. Would we go European soccer style? Where the 4 most profitable teams are the best. Leafs could become the MAN U of the NHL

The richest most profitable team is one of the least successful finishing bottom 5 (2 of 3 past seasons) and the only team unable to make the playoffs while spending to the Cap ceiling, with the playing surface leveled in a Salary Cap World. Meanwhile the poorest team Phoenix on NHL life support, playing at the Cap floor is competing in the final 4 of the Cup finals.

There is your Bettman parity for you..

Now the NHL wants to make things even worse for Leaf Nation Fans as their new CBA terms (the hill they will die on) will make it even harder for the Leafs to be competitive..

Raising the UFA age so that less players hit the free agent market and later. Combined with short term 5 year contracts with 7 years to resign your own players, with 5% variance per year. This will be incentive for players to resign with their own teams far more likely to get the extra 2 years contract security.. When/if they choose UFA status there will be more competition for the same players as now rich teams can't flex their $$ muscle using long-term or upfront loaded contracts that budget teams can't afford to hand out to secure the prized UFAs.. Laws of supply and demand apply so more teams competing for the same players limited financially as to contracts allowed, makes odds of landing a UFA harder. Money being equal across the board for all offers, means now team competitiveness and location will become more important factors in players decisions as to where to play.

So unless Leaf Nation fans want their team to be punished even more than the Cap system does already then they had better hope the NHLPA win this battle on player contracting rights or its more bad news for Leafs ahead.

According to some article I read over on Yahoo, there exists a possibility that the NHLPA could decertify. The NHL papers that were filed in court asked for all player contracts to be declared null and void should that happen. I`m sure this is a simpleton explanation, but what it all means is that Toronto might actually have a shot at building a winning franchise. If in fact we are a team that so many NHL player grew up loving, how could we not clean up by finally scooping all that talent up off the free agent list in the greatest July in hockey history? Let`s face is, this would in fact be our best shot at winning a cup in the near future. Post your home grown dream team boys, it could possibly happen!:laugh:

Blow it up and set them all free is the best thing that could happen for Leaf Nation, who have suffered through 10 years without a single playoff game.

Burke's 5 year accelerated plan to being Cup competitive could come to fruition over night, after NHLPA decertification.

Steven Stamkos --- John Tavares -- Corey Perry
as our top line next season could take the Leafs from the bottom to the top with just the stoke of a pen getting these players under contract by the Leafs GM, bringing Ontario born kids home.

Leaf fans are being punished by there teams incompetent mang not by what a new CBA may bring .
 
Seems silly to take 5 days, but I don't know the rules in their constitution.

Any bets if they gave them 24 hours the complaint was they didn't give all the players a chance to vote.

It is just spin depending on whether you support individuals or corporations.

Donald Fehr is a master strategist and like a great chess player he is the Bobby Fisher of these negotiations and everything he does has purpose and meaning..

Case in point here.. The players are voting in regards to a "disclaimer of interest" which is different legally than "decertification".

While decertification is the players walking away from the Union, a disclaimer of interest is the Union walking away from the players. It can be as quick as Donald Fehr sending a letter to the Commissioner's office declaring the NHLPA no longer represents the players as a bargaining agent. There's no vote, no petition and no decertification election.

So unlike a "decertification" PA vote which requires 2/3rds agreement/support for the PA to dissolve the Union and walk away from Fehr a "disclaimer of interest" doesn't require any vote at all technically for Fehr to step away from the Union.

So one must ask themselves why is Fehr calling for a vote that isn't required?

It has many possible benefits including forcing Bettman's hand, showing PA resolve behind Fehr to the NHL which would make a decertification vote only a formality in the future if required. Also if the NHL's lawsuit complaint is overruled in court, while the PA delays and votes (which isn't required) it will make the lockout illegal by the owners and PA have clear sailing as the NHL will be forced back to negotiating table releasing their demands knowing the PA is in the drivers seat. etc etc.

Teams who can't afford to compete and sign the top players will be in immediate financial peril after they fall to the bottom of the standings and their buildings are empty because they can't sell tickets for their crappy teams. The NHL will never let this happen.

The NFL & NBA players all got a deal done recently they are far more easier to deal and reason with.

The NHL would have no choice, unless they opt for collusion, but to have free markets prevail. There would be no NHLPA, no CBA, etc. which are the groups/documentation that restrict such a market from occurring.

Also, the NBA's union was in the midst of decertification when the deal was signed, perhaps the NBA felt the pressure?

Won't happen.

No the NBAPA are the ones who thought twice about going down the decertification road and signed the NBA's final offer.

Take a look at that, NHL lead by gary bettman has already messed up a lot..... And its not getting better. Why not decertify might make things interesting.

The NHL's decision to file a pre-emptive lawsuit against the NHL Players' Association appears to be based on a desire to show the union that its plan to file a "disclaimer of interest" in order to allow the players to file antitrust suits against the league will fail.

And I believe the union's plan will indeed fail because Judge Paul Engelmayer, the young but brilliant federal judge in New York City who has been assigned the case, will see right through the formality of the disclaimer of interest to the underlying substance of what it really is: just another negotiating tactic by a union whose death will have been greatly exaggerated.

And that will mean that the players' antitrust suits will continue to be barred, just as they have been while the union has been representing the players. It also means a settlement -- or at least a settlement that the union will be happy with -- is not just around the corner.

NHL Owners know its in their best interest to allow Bettman to give his 4th and final take it or leave it offer with less take-backs, as that is better than the consequences of free market enterprise and 800 UFA players suddenly hitting the market in a free for all feeding frenzy.

This Fehr lead tactic is designed purposely to get the Owners back to the table in hopes that a successful CBA can be reached.

800 instant UFA players isn't even the bad news for the Owners..

The first step after decertification is filing million upon millions anti-trust lawsuits against the NHL owners for breach of contract once the Owner imposed lockout is ruled invalid which occurs as a result of decertifying.

US Anti-trust legislation states that 3 X lost wages is possible an outcome of a successful case.

It shows Salary Lost : $636,320,217.83 and if you times that number by X 3 = $1,908,606,653.49.. So Owners face potential anti-trust violations that could cost nearly $2 billion in damages (or some portion thereof)..

This would happen before we would get to 30 NHL owners trying to sign 800+ UFA players to contracts.

Even the potential thought of all this for the Owners should get Bettman back to the negotiating table with a better proposal than what he has been offering up to date.
