I wonder if that's been brought up at all between Phoenix/Tempe, or if that might be brought up at all down the road possibly?

Well, those possible complainers are already neighbors with the notoriously quiet airport with 4800 jet engines screaming all day and night.

Craig Morgan posted a pre-game warmup article that includes player rosters.

Was just informed it’s unlocked. Included a couple of things that I hadn’t seen before.

Channel 11 on COX right?

Reading the Morgan piece : really looks like it'll be a yes. Seems the city really want this project and that the boogeyman job of Phoenix and it's goon the airport, haven't discouraged the city officials that'll be voting.

I know a yes is not a warranty but; at least it's not a no.

It was a "yes" the moment it went on the agenda. It was a solidified "yes" when the city manager recommended approving the item in the packet.

Unless you're morbid enough to want to watch the public comments, you can skip it and just get ready for the Warriors to beat up on the Celtics.

You can see the appeal to Tempe - this promises a way of remediating an central piece of land for no cost to the City. I can't see why they wouldn't want to explore further, even if they ultimately say "no" down the road.

CF... did you ever retrieve that letter about the IGA from PHX's legal team over to Tempe??

Was wondering what you thought.

I did take a look at that.

I was a bit surprised to see PerkinsCoie on the file. Cabou is a Phoenix-based partner who specialize in White Collar & Govt Investigations.

My take is that it is a saber rattle. The 1994 IGA in question was apparently signed when Tempe objected to 3rd Runway construction at PHX (ironic that it was the inverse of what we have now, the Airport trying to block the city. Back then it was Tempe trying to block the Airport - such is the way of these things)

Phoenix now says they'll: A) sue to enforce the IGA - which is not the type of case they want. A nearly 30 year old agreement on what can be built in the Salt River riverbed is going to be scrutinized by a court - regardless of what the terms are. Such is the nature of agreements - they say one thing, until the court determines it really means something else, or is archaic, or any number of other ways a case like that can go off the rails.

Or B) sunset the IGA. That to me seems like the saber rattling. My assumption is that the IGA still has provisions that are beneficial to Tempe. PHX is hoping to get their attention with the "end the RFP or we'll take our IGA and go home"

Well today's vote isn't a final. Could take another couple of months.


Nick Woods addressing the bond structure. Woods says the structure has changed. Rather than using bonds for the parking structure the Coyotes will pay for that.

Meruelo now putting $40 million non-refundable cash up front for land remediation.

Some of the assessment numbers are being changed. Numbers coming too fast to keep up.

That 40M, if it's a gift, starts to balance the 200M in tax breaks. I would say that Meruelo seems to be playing this straight up, and it doesn't sound like a scam deal, as least not yet.

And, I wouldn't have said that 2 months ago.

Seems like a pretty deep hurdle to overcome.

Sky Harbor.... making the hard case for having residential units in the project.

Claims it's not about the arena.... but it is.

Craig Morgan wrote in his article that I linked this morning at least two city council members in Phoenix would like to woo the Coyotes there.

Sky harbor is trying to throw stuff that sticks and here's the problem it won't stick cause there was other development near that airport that includes residential units that Sky harbor didn't not make a single peep about.

Their argument won't hold up. They didn't challenge those other projects from happening due to the same issue they are complaining about now. If they try to take them to the courts they won't win cause of the other residental units being built near that airport.

Not if Tempe dumps the IGA. Which is what Phoenix and Sky Harbor wants. Because it heavily restricts the flight paths in and out of the airport.

What's at issue is the low density versus high density residential. The zoning, by agreement, was never allowed to be high density. The Coyotes development includes high-density.

And yet they never bothered to make a peep about other residental structure that were built near the airport. That will be used against sky harbor if the airport files a lawsuit over it.

Tempe's suit against Phoenix and the FAA in the 90's brought about the IGA. I don't see Tempe wanting to eliminate that. Sky Harbor unchained is not a good option for them.

This seems like what I am hearing, too. This piece will make things interesting. Perhaps a quiet warfare between Phoenix and Tempe is in the offing.
