I posted in the Prospects thread on the new Class Action lawsuit alleging that t hecCHL (QMJHL ,OHL, and WHL) are violating U.S.Anti-Trust laws in that the plaintiffs allege that the CHL operates as a Cartel limiting players rights to play for whoever they want to and also suppresses their salaries and other economic rights (like with NIL's use of their names andv mages to earn revenue for themselves) ...The plaintiffs also are calling for an injunction that the CHL draft (of 16-17 year olds and exceptional 15year olds) be stopped because without a CBA, it restricts where players can play ...they cannot choose what team they wish to play for.
This does not challenge the NHL Entry Draft which is covered by the NHL CBA ...but the NHL is also named in this lawsuit as a partner with the CHL because it funnels money to support the CHL and pays teams for drafting players from the CHL.
I pointed out several messy issues in this lawsuit (I am not a lawyer) ...apparently tge pjaintiffsxare some current CHL players who are trying to unuonize and this forcexa CBA on the CHL to resolve some of these restrictivevissues by bargaining process..
This implies that the plaintiffs in the class action are all over 18 years old because I do not think minors (under 18 ) are allowed to form a union or join a union...must be of legal age I think?
This coukd mean a separation of interests by younger kid players wanting to get drafted by a CHLteam and who would accept any restrictive rules on their earning power or right to choose where to play just for the chance to play in the top Junior Development leagues of the CHL, vs . the interests of the older 18+ ages who technically are adults for legal purposes who can unionize to better their economoc remuneration or demand a portal system to decide what team is best for their continued development and attraction for pro teams wanting their services via drafting them or signing them as free agents.
Since this is filed in a U S. COURT with U S. Anti-Trust laws in play ,maybe the Canadian clubs can avoid being penalized for damages and relief sought if they simply dump any U S. Pkayers on their teams ...and maybe the CHL avoids any damage penalties awarded if they dump all their U S. teams in the 3 leagues under thecCHL umbrella?
If damages awarded then it could crush the economic feasibility of the CHL to continue in operation..
This would affect drastically the NHL pipeline and the NHL Draft if there were no CHL
Imagine no QMJHL,OHL and WHL!).
If the CHL wants to continue it might need to allow a CBA for its players over the age of 18 to be bargained for if they form a certified union..
Whether the unionized 18+ pkayers can bargain for the interests of the younger underx18s ,I do not know but tgeyoubgervones who cannot unionionize or vote on bargaining issues woukd have to accept any deals made for all players in tge CHL negotiated by the unionized bargaining unit anyway.
IF the CHL decides it cannot continue by allowing for some kind of CBA with unionized players, and they close down it could force them to either re-opeb as a strictly u-18 set of Junior leagues ...or if they might go back to a system where by NHL teams each sponsor/own or co-own a CHL team (as on the old days when Bobby Hull and Stan Nikita played in the OHL with St Catherines as a Junuor affiliated team run by the Blackhawks ...But to avoid U.S Anti-Trustvkaws eitger no pkayers on such teams can be Americans and bo such teams can be based in American cities IR they operate as ONLY an 18 years + Junuior League and the adult players join eitgerctgeir own union or maybe joining the NHLPA to bargain a CBA with these Junior leagues?
Very messy issues...a threat to the current NHL pipeline if it forces tge CHL to close down or change the age range it currently is designed for .
Or a threat to NHL teams' profit lines if they must subsidize the CHL cover increased expenses due to being forced to pay much more to players
than currently....
As to any work restriction imposed by the CHL entry draft,I think the CHL may argue players are not forced to go to teams that draft them...they can:
. Play in Junior A leagues then go to University in the NCAA or to a Canadian USports team .
.in some cases play in a eiro pro league...
So there is no total restriction on where they must play.
Your comments on this potential quagmire for the CHL and NHL please....
