Donald Fehr's mistake was to ask for Mediation to help resolve this dispute when dealing with the NHL and its tactics..

What he should have asked for is a Lumberjack, someone experienced with working with wood products, as that may have helped pull the stick out, that seems firmly implanted up Bettman's ___.

i suggested a 6 team contraction with the last lockout

The talent in the league is to saturated. get rid of those 4th line plugs and goons. With an 82 game schedule teams should be able to roll 4 legit lines and the fans can watch good hockey for the entire 60 minutes and every game.

Too many adjustments would have to be made. You'd have to raise the salary cap. Re-organize the divisions / conferences. I'd rather move the teams and let them actually be successful.
 
I'm getting really tired of listenting to the daily reports on the lockout . Fehr has no interest in ending this dispute untill the last second so they shouldn't meet until the new year .
 
That's my point. Hockey is not #1 popular sport in Russia. It's probably tied for #2 with basketball. Soccer is everything.

and the food doesnt suck, :laugh: it's different, but it's same pork and potatoes base as the rest of Eastern Europe. Weird that Lupul has Ukrainian roots and the food freaks him out?

Right, we're talking about folding a bunch of teams, and moving the rest to locations where they could at least break even. The bar is set pretty low when teams like PHX/NYI are used as a measuring stick.

If you move the 3 worst teams to hockey markets, and have a 50/50 split of HRR-AE, you immediately improve the overall health of the league.

Even if those teams only break even, it leaves more revenue sharing (increased as per both parties suggestions) to be distributed amongst fewer problem franchises.

But I got to tell you, outside of Moscow and St Petersburg, is the real Russia (something they say in Russia). Not any Moscow resident can live in a place like Ufa.

Well, it makes the lockout kinda illegal, but it also technically makes all the agreements and contracts null and void. In other leagues it made for a faster resolution. I think it's just a ploy. They are too close for drastic measures.
 
It's a last resort scenario, the union dissolves and the matter goes to courts.

In a Disclaimer of Interest, the Union wouldn't dissolve. They would just stop representing the players in this negotiation, thereby, helping the players in an anti-trust lawsuit against the owners. Once an agreement is reached, the players can reclaim interest in the Union and voila! The PA would again represent the players. The only thing decertification would do is put pressure on the owners to make a deal quickly, or spend a bunch of cash and time in litigation.

Decertification dissolves the Union. Which means, once finalized, the NHLPA as we know it, would cease to exist. Basically, all teams would be able to spend what they want and treat their players how they want.

Should the 30-member executive board be given the right to “disclaim interest,” it doesn’t mean that it would do so.

For instance, NBA players filed a “disclaimer of interest” while they were locked out last season.

However, they ended up agreeing to a new CBA with the league 12 days later and the union was reformed.

Fehr at least tried to negotiate with the NHL but Bettman has said right from the beginning that they have take it or leave it offers.

The only option available when one side will not enter into a negotiating session for a Collective Bargaining Agreement is to make everyone independent so that the negotiation is player to team without an overriding control mechanism (CBA).

The owners should be happy as they won't be forced to pay to the floor, and the players can negotiate individual contracts, or have their existing contracts enforced by the courts without worrying about a CBA.

If players will sign non-guaranteed contracts even better. Teams that guarantee contracts will likely land the best talent. For non-guaranteed contracts we can expect huge signing bonuses.

With no draft graduating juniors can decide who they want to sign with, so draft pick awards for being pathetic will no longer exist.
 
If it goes through it absolutely helps the Leafs and about 10 other teams. But it will kill most of the league.

It would be nice to freely enter into negotiations with the likes of Stamkos, Weber, et al. I wonder if Burke would be 'encouraged' by his new bosses to offer longer contracts or if we would left empty handed with all the other money teams offering longer deals.

What the owners may not be happy about is anti-trust law suits.

If the membership allows the authorization, the NHLPA would have the authority to terminate its right to represent the players could potentially inform the National Hockey League with a declaration that the union no longer represents the players as a bargaining agent. Players could then file their own lawsuits seeking to have the lockout deemed illegal, something that could see them paid triple their lost salary in damages if successful.

If Fehr ends up getting the players 3 X lost wages I think the players will be happy. Owners would probably tar and feather Bettman shortly thereafter.

I'd prefer a 24-26 team league, but losing those teams that way is embarrassing and the worse way to go about it. Slow death and contrition is not what the league wants. I don't think it will ever get that far.
 
God, this makes me so mad. Cut out the mambo jambo, they not making any money and driving the fans mad. Time to cut bait.
 
This is a smart move on behalf of the players.

As long as they can stay united without a formal organization they are going to be individually and collectively very powerful.
