Don’t disagree, but that doesn’t answer my question. Can a team release medical information without a players consent? And if not, was it Eichel or the Sabres refusing to release it? I agree it wasn’t smart if the goal was to facilitate a trade, I’m just asking for clarification.
I would imagine Eichel either hands over the requested information, or he signs a limited release consent form. I would assume the latter, becuase if he willingly hands over the information, HIPAA may no longer apply, and they could freely disseminate that information. If he signs limited release, it would limit the provider from only allowing his health information related to a specific information, and it likely still confidential. I'm sure Eichel does not want to simply sign a normal HIPAA consent form, because they could access all his past health records. I'm not a legal expert, and I have limited HIPAA knowledge, so take this with a grain of salt.
I think GMKA absolutely has to get a good return in this instance, because he looks really bad if the surgery is successful, and has no long-term effects, while the other GM looks like a genius.
