i''l try one more time

either he pays taxes in the US or in Canada based on the tax laws

why he signed here or what other teams offered has ZERO to do with where he should pay taxes and isn't part of any legal argument

there is no argument to be made that Johnny based his decision where to sign on where he would pay his taxes so he should be allowed to pick the lower tax jurisdiction

Like I said, you struggle to follow. It's okay.

No reason arguing about it. I have accepted you don't understand why it's necessary. I do.

I guarantee you he's not telling the courts that to brag about how rich he is.

Obviously that isn't his argument.

You do not understand his argument and believe his lawyers put it in there for... sympathy? Okay.

his argument is easy to understand

your the one struggling with trying to defend your position that why he signed here and what other teams offered has any bearing on the tax laws

and it's funny how your keep saying i don't understand his argument but never mention what i supposedly don't understand . lol , which isn't surprising since all i'm saying is why he signed here and what other teams may have offered have zero bearing on the tax laws

So if I don't have an argument what am I failing to defend?

Nothing you've posted has made any sense yet. You seem mad at Tavares though.

Please illustrate what you'd like me to defend.

You seem mad at Tavares because you don't understand his lawyers argument.

I say you don't understand his argument and that's okay and now I'm supposed to defend my position?

You're carrying the goalposts with you.

and what are there arguments ?

It's right there.

He signed in Toronto for less money than other teams offered because he was offered tax advantages, which he got every subsequent year.

The CRA is combining his 2017-2018 and 2018-2019 income into one, which is what he disagrees with

OFFERED , by who exactly ? certainly not by the CRA and that's why there going to court

and his belief he was entitled to the tax breaks has zero bearing on the law which is all i'm saying and which you disagree with

Why should a player combine their income for 2 different seasons and have to pay tax on both combined in order to create a higher tax bracket?

The whole argument is the CRA took his signing bonus as that years salary which they only did for 2018. They took two years of salary and put him in a higher tax bracket for no reason.

The law allows Tavares' bonus to be taxed differently, which is why he's not going to court for 2019, 2020, 2021, 2022, 2023, and subsequently 2024 and 2025.

Since he was playing in America, they miscalculated.

this has nothing to do with my only points being that why he signed here and what other teams may have offered has no bearing on the tax laws which you disagreed with

He’s looked better again tonight.
All Star break was good for him.
he's looked better on the PP , 5 on 5 not so much

No bearing for the CRA, sure.

It has bearing for the Toronto market though.

no idea why what other teams may have offered would have any relevance to what he owes in taxes ?

is he looking for sympathy or are his reps trying to work some weird angle where sports fans will put pressure on the CRA to give Johnny a pass out of fear that players won't stay/sign in Canada

It looks to me that the possible relevance has to do with the language of the Canada/US tax treaty.

From the National Post article:
Tavares argues the bonus should have been taxed at only 15 per cent under a provision of a Canada-U.S. taxation treaty, which sets the lower tax rate for “inducements,” such as signing bonuses, paid to athletes, artists, actors and musicians.

Not a lawyer and haven’t read through the full tax treaty to form an opinion. But if the quoted article section is accurate then disclosing what contracts other non-Canada teams offered Tavares could be relevant in arguing the signing bonus from the Leafs qualifies as a “inducement” under the tax treaty,

This basically summarizes the issue that Tavares is appealing: 14 July 2022 Internal T.I. 2020-0869441I7 - Article XVI(4) of Canada-US Treaty | Tax Interpretations.

How about we discuss hockey on a hockey forum?

JT had an assist tonight (a beauty), which means he now has 3 assists (no goals) at 5-on-5 in his last 22 games.

Well, the two issues are conflated because it's an issue of the overall structure of how Tavares is paid. Having 80% of your $77m contract paid in "bonuses" to avoid the tax implications shouldn't fly.

Obviously, he spent more time prior to July 1st, 2018 in the state of NY, but it's still greasy and underhanded.

Not sure how it’s greasy? There’s literally a tax agreement/treaty made for these purposes. He took advantage of a law that’s been put in place to help high earners.

It’s very clear that Tavares will likely win. It’s a miscalculation. He spent most of 2018 earning an income in NY State. They’ll recalculate and account for that and he’ll pay the recalculated amount.

JT was good this game. He seem so good that he dont need Nylander by his side... Maby give JT his own third line :D.
