This entire case is going to hinge on consent. This will be a criminal trial, not a civil trial. The burden of proof is going to have a high bar. Without footage in the room, without texts from the victim at the time it happened, and without the defendants having admitted that they committed a crime, this will be he said she said. Really tough to prove in the context of a criminal trial.

With so many suspects I'm guessing plea deals could play a part. Someone with a guilty conscience might crack at the opportunity of receiving a lesser sentence if they think they'll be found guilty.

And what about the people that were in the room and then left? They might have a significant role to play as well.

Yep there’s that. If the prosecution has testimony from players who went into the room and testified that these acts took place without her consent, that would help. But it’s just as likely that players who went in and out have no idea whether it was consensual and were smart enough to know not to stay in a situation like that. They might be hesitant to admit they believed she was being assaulted because then they would be in trouble for not calling the cops and just letting it happen. So it’s more likely that witnesses would say they don’t know if it was consensual. Again, really high bar here.

I doubt the rooms they were given were mega suites. If you are a girl who has just been used by five men and are now confronted with EIGHT large young me in a regular hotel room, 1) there wouldn’t be any room to do f*** all, and 2) what might your worst fears be at the time????? Seriously, try to imagine the scene.

Not to mention what the Globe and Mail reported to be allegedly said about golf clubs.

i do agree with you use of the phrase “Jesus Christ” though.

Pedophilia; not the high school girl kind but the prepubescent kind. That and rape have the biggest stigmas attached to them IMO, and rightly so. Murder has a lot of variables and it depends on the circumstances but I think society generally has more disgust for pedos and rapists
There’s absolutely no defence for child sexual abuse so it’s rightly incredibly stigmatized. Can’t possibly mistake there being consent and cannot possibly not know it’s wrong (short of an incredible level of mental impairment). Then there’s the lifetime of damage it can impart on the victims. There’s a good reason even other criminals hate child sex offenders

I gotta say, I'm not surprised that it's Formenton whose name first comes up.

After the initial story break, his camp was the lone camp that made no statement whatsoever.

Very good sophomore NHL season and suddenly disappears to Europe.

I don't know anything about how legal proceedings are run but to me it seems to be a pretty bold swing to come right out at the start and make a public statement that he will vigorously defend his innocence (as opposed to no comment, etc). Guess he wants to get on the PR battle right away.
Lawyer tactic to try to sway the public. Better to come out guns blazing even if you are guilty. Means absolutely nothing.

I think only one of the players is possibly good enough to deal with the headache from a PR angle if they are allowed to play again. As has been said by others, the optics of this aren’t good. None of these players is Tyreek Hill good either. I think there is a good chance none play in the NHL again
Agree. Mitch Miller looks like a choir boy in comparison. And I say that with all due respect to the young man he tormented.

Yeah they are deservedly the lepers of both the criminal world and the normal world. It’s probably the crime where the criminal’s safety is most at risk. With a little more thought I’d probably throw necrophila into the list of rapists, pedos, and some murderers, but I’d bet it’s combined with the latter often. There may be no proper “victim” that suffers (unless murdered) but it is a skin crawling crime where people would want no association with the perpetrators because of the alien-ness of it

I responded factually to the question you posed.

Contracts can be terminated if one party believes the other party has acted in a manner that is materially contra to the clauses of the contract. If the other party disagrees or believes the act or omission can’t be proven, then they can file a claim for wrongful termination of the contract.
The NHL has made great huge programs and initiatives to be inclusive.

When / if ( presumed innocence) these players are found not guilty they will have to bring them back.

Charter of Rights in Canada does not allow for sexual discrimination.

Gang Bang sex is not illegal….If that’s what all consenting adults agree to it.

That’s not even remotely the truth. They may “have to” pay them the rest of their respective contracts due, but they most certainly do no have to bring them “back”. They are not entitled to anything. Mitch Miller is a perfect example. Bruins have to and are paying him his money, but don’t hold your breath waiting for him to play in the NHL.

Will that be the case with these guys? Who knows, but they ain’t guaranteed squat outside of whatever contract payments they have in place. And even that my be open to question depending on the language/terms in those contracts.

You are very gullible or a bad reader of the facts given .....if you believe the players were brandishing golf clubs and threatened the girl with said clubs.

The Globe and mail were just quoting the statement of fact the accuser lawyer wrote in the initial filing of a civil law suit against Hockey Canada. The laccusers lawyer that wrote that statement said there were golf clubs in the room , of course they were at a golf tournament,

Some context may help, the Canadian judicial system is all conviction-based. So what they will do is put forth lesser charges in the hopes of getting a plea deal, if the defendants refuse and want to go to trial, they will then add a boat load of charges then offer another plea deal. Its usually a scare tactic.

I think you're misunderstanding the Charter protected grounds, as well as the NHL's inclusivity program.

And Formenton's legal team's statement said that he'd vigorously fight the charges? Quelle surprise! It is standard defense to immediately go on offense against rape complainants.

You don't need to keep playing devil's advocate for accused rapists. Society has always had that more than covered.

30 point player in the NHL, couldn't even get close to a point per game in the SWISS league. That probably has something to do with it.

Allegations aside, he was a very useful player for the Senators and his absence was felt.

He’s one of the fastest players in the league, is an excellent penalty killer and was surprisingly gritty and physical.

Well it’s already been covered that they would only have to pay them not let them play again. Regardless, sex (as in gender) and sexual orientation are protected classes when it comes to human rights and discrimination. Engaging in specific sexual acts (i.e. group sex) that is unrelated to orientation is not listed as a protected ground in the human rights act in Canada. It would be an interesting case and precedent to set but engaging in non criminal but potentially unsavoury activities isn’t a protected ground when it comes to discrimination
