In broad terms, the casino is on First Nations land so the Plaintiff is arguing that tribal law applies. Some of Melnyk’s defences may not have application under this body of law. I suspect they are the equitable defences relating to being coerced, etc.

The filings have been coming pretty steadily but with less interesting material. Trying to figure out where everything stands seemed like work.

The lack of coverage in the local media is a sad reflection of the decline of newspapers.

Also, the inflammatory language in the files arguments completely lacks the decorum that one sees in Canadian courts. It’s very unappealing.

I don’t read newspapers anymore. I get all my facts from HF BOARDS forum 19 :sarcasm:

I have no idea what this means, I can only assume that it is another case of Melnyk being Melnyk. Any chance of a "Tribal Law for Dummies" explanation?

I believe the plaintiff (casino) is trying to pick and choose which laws to apply; Connecticut law or Tribal Law, whichever happens to be beneficial. I only casually glanced at the link but I think it is Melnyk's legal team's response.

Which on both sides seems entirely predictable. Law is all about making the laws work to your benefit.

In some situations, both will apply. It’s possible that Tribal law applies, but the statutes fill in the gaps. This used to be the way maritime law worked, perhaps it still is. Then you can argue all day about whether a gap in the law actually exists and if so what fills it in and how it is applied.

For a fairly simple matter, this case is getting awfully complicated.

Seems pretty cut and dry...Melynk owes the casino money, no matter what laws are applied. Unless they're going to pull out some Ferengi rules of acquisition, Melynk is no leg to stand on.

I honestly don’t feel he has any power over the local news media. Maybe some of the sports reporters feel they need to be cautious but this isn’t something in their area. Unfortunately Eric Macramella can’t comment due to conflict.

He told Brent Wallace that he "would ruin him", kicked Ken Warren off the charter, Marcramella "can't comment", Don Brennan seems to have been shipped to Robidas Island, Simmer was once banned from conducting any interviews with members of the org, yet he has no power over the local news media?

But that didn't stop him from commenting on Randy Lee or the Karlsson/Hoffman situations?

Actually could be that Gowlings acts for TD which is an involved party. Or acts for someone in a joint venture or litigation with Melnyk.

It doesn’t take much to have a conflict. Could also be that his firm doesn’t want him speaking out on this for some reason - maybe they are courting his business. That wouldn’t be a true conflict but close enough.

Those are sports people not news media. Other than Macramella the others are not qualified.

It's pathetic the media has to be "muzzled" just because the org is a walking PR disaster.

Don't want the local media to report bad things about you? Don't give them bad things to report on.

There's not much journalism going on in really any mainstream media in my eyes these days, and certainly not in Ottawa and even more so in the Sports scene, I mean I understand it but still feel it's a pretty sad look, I thought a few of the more veteran folks would stick their neck out but alas nary a one really has, just look the other way and move along!

The only one we had, believe it or not, was Don Brennan, who still provides some light jabs on Twitter, but he seems to have been completely erased as a Sun Sports columnist.

Ian Mendes took it on the chin when he dared to write about it or ask Dorion any fair questions. The org has him on the **** list now.

I suspect that articles about Melnyk's legal issues don't sell papers (or create clicks online) outside of the sporting world, so non-sports media could care less about it.

Not really factual unless you get Ian on here backing you up on that...

Eugene Melnyk called Mendes bush league and said he won't do interview with him anymore after Mendes asked Dorion to listen to a fans comments about the Stone trade (he didn't call him out by name but he was clearly talking about Mendes). It was on live CFRA.

And yet, he still gets Senators players on his show. I don't think he is on any blackball list as TSN1200 gets a lot of players on the show
