Its still baffling what Melnyk thinks his endgame is. He is just stringing them along cause he's rich and he can? He thinks he can win? The only defence that makes any sense is that he thinks he was cheated but that wasnt in his- pick one of these 3 defence strategies. Its like he's home wearing sweat pants saying i dont care about my reputation anymore which cant bode well.

I mean my only somewhat cogent and optimistic thought is that he is actually out of liquidity and is stringing this along to get himself to some near term point where he has .. more liquidity.

That would make sense, but he has to be $50K deep in levels, and he has blown any possible forbearance in terms of cost and interest.

The most sensible explanation, in legal terms, is that he is bats+++ crazy.

I think he's simply insane.

And no one in his inner circle seems to have the ability to talk sense to him any longer.

If you lie to the courts, to forensic investigators - you are what you are.

If you are suggesting his ultimate demise, that would not discharge the liability or bring an end to the suit.

In my opinion, and not based on any rumour, but I believe after seeing Melnyk in public the last couple of times that he simply looks very ill. What are the risks in liver transfer for patients who are his age? Could he be suffering from another illness possibly unrelated to the liver transplant too? There is a strong a chance his time (much like ours, only faster) is ticking away and he simply does not care anymore.

HYPOTHETICALLY speaking, if hypothetically he were very ill, it's possible that the stall tactics have more to do with his hypothetical recovery/hospice attempts from said hypothetical illness, and delaying any pending legal issues until such a time that the implied stresses of a legal case can be managed in good health, or otherwise dealt with once any hypothetical health issues had run their course.

(This post deals with strict hypothetical scenarios, created for the sake of a generic and academic debate on legal strategies and responsibilities in the face of random events, and as such are a work of fiction that are in no way insinuated to be real, legitimate, or otherwised based on reality. I thought he looked bad on tv at a game last month. I also am aware that a major long term milestone after liver transplant is making it to 5 years, and he’s approaching that. No speculation, just saying what I saw. They’re probably not linked to be honest. He might just look bad because of years of stress and being a huge jerk

I have no idea what this means, I can only assume that it is another case of Melnyk being Melnyk. Any chance of a "Tribal Law for Dummies" explanation?

In broad terms, the casino is on First Nations land so the Plaintiff is arguing that tribal law applies. Some of Melnyk’s defences may not have application under this body of law. I suspect they are the equitable defences relating to being coerced, etc.

The filings have been coming pretty steadily but with less interesting material. Trying to figure out where everything stands seemed like work.

The lack of coverage in the local media is a sad reflection of the decline of newspapers.

Also, the inflammatory language in the files arguments completely lacks the decorum that one sees in Canadian courts. It’s very unappealing.

The lack of coverage in the local media is also a sad reflection of the power Melnyk seems to yield over a good chunk of them.

I am sure James Bagnall is in the process of writing a Mohegan Sun hit piece as we speak.
