Civil cases are decided on a balance of probabilities whereas criminal one’s are beyond a reasonable doubt. Different onus/threshold. In other words, just because someone is found innocent in a criminal case, does not mean they’d have shared the same fate in a civil one.So, dunce hat time. Should this go to court under criminal charges, and the players are found not guilty, does that mean Hockey Canada can sue for that 3.5mil back? Or was it a case that they were charged on the handling of the incident?
