Consensual gang bangs are a thing, but if these players got forceful and rough in the process (without her consent), it's 100% rape.

Like if you bring a woman home from a bar, and she agrees to have sex... Does that automatically give you permission to do whatever you want in the bedroom, including physically forcing her to stay if she's hurt, cries, and tries to leave?

Seriously need to give your head a shake dude (and no, not the little one).

I disagree. If I can stop one person from going to law school then an angel will have earned its wings.

My wife is a lawyer and a litigator.

One of her recent cases was to gain compensation for thalidomide victims who were dosed after Health Canada banned the drug and who were therefore outside the compensation window.

In these cases, doctors either through their remote locations, ignorance or incompetence, were unaware of the ban and continued dosing but the compensation window established by the Government of Canada only applied to the dates where the medication was legal.

In another case, she helped a woman who was being emotionally and mentally abused by her partner who refused to leave the home that was her legal property.

I find your blanket statement to be incredibly insulting to the people who dedicate massive portions of their working lives towards helping people who don’t have the means or skills to help themselves.

As someone with a law degree, you should know better. It’s all well and good to rail about the inadequacies in the system but in the meantime real people still have real problems they need help with.

For me it comes down to an easy two letters. "No".

If she communicated that in any way - verbal or through body language - then its rape after that.

But call me the bad guy if you want here - but based on the last video dialogue we heard, Im not yet 100% convinced that "no" was said that evening.

Its pure speculation to say that she was forced to say on camera that she enjoyed it, or to say that John Doe 1 was acting "paranoid" playfully after the fact. Thats some deeply disturbing shit if true though if she was acting to save her life.

Im not sure why its controversial to quote her direct on that either - or to question if she was being truthful when she said it.

Thats a fair question to ask if you havent already made up your mind.

Deep down, I do believe in innocent until proven guilty, and strongly believe no defendants should be publicly named until they are actually proven guilty (and I believe this should be the case with sex crimes for everyone in general).

However, fact of the matter is the vast majority of rape allegations made turn out to be real, and victims face so much shit to prove it, which keeps other victims from talking (most rapes are unreported).

I'd also love to believe everyone on the 2018 (and even 2003) Canada WJC roster was perfect little angels, but most teenage athletes are a ridiculous breed of douchebag, so overall, I'm going with the odds on this one (I believe the victim, and if she's proven correct, Hockey Canada should be abolished, and the guilty players publicly shot to the moon).

Consent is about three letters: "Yes."

If I ask you if I can have your car and you're watching TV and don't hear me so I take your keys and drive off, did you consent to give me your car ?

The absence of a no is not a yes.

There are tons of great lawyers out there. Sounds like your wife is one.

Too many people go to law school and end up in crippling debt and without job prospects. I do not think it’s a good career choice unless you’re really passionate (which most trial litigators are).

Also, it was a bit of a joke as should have been evident from the tone.

Jesus, why would you want your friends to join you sharing a woman so badly? Boggles the mind.
It’s basically misogynistic isn’t it. The woman gets treated as a sex toy and not a human being… then afterwards they’re all high fiving each other… whilst making her film a consent video. Or am I mixing up the incidents?

Honestly what I can’t wrap my head around is how drunk 17-19 year olds with next to no education besides knowing how to play a game are smart enough to coheres someone into making multiple consent videos and getting them to shower.. thinking 2 steps ahead for a rape kit.

Something isn’t adding up

Knowing that DNA evidence is a thing isn't some super secret genius concept that you need a university degree to know about. I mean, I'm sure most of them have watched an episode of CSI before.

They may
The police already investigated and they found no evidence of sexual assault.

You're actually calling the police liars.

If you actually believe that the police don't lie... you're beyond help and people shouldn't even bother carrying this conversation any further.

If I'm sitting in the car and you ask to drive drive off with it and not only do I not say no - but I say yes instead - it gets a bit weird....

25 out of every 1,000 sexual assault cases lead to jail time. There is a reason women don't come forward and it's because the justice system fails them time and time again.

The system is not set up to protect the weak, far from it, it is set up to protect those who set it up in the first place.

Exactly. We can only hope that if these cases are now seemingly being treated seriously that if there are any other victims out there they may feel able to come forward. It’s not an opportunity for people to pile on as some infer but for any potential victims to get justice and get some power back.

Historically victims don’t get taken seriously and if it goes to court get torn apart, getting emotionally raped again by the legal process - all with awfully low odds of justice. That’s why some victims take a pay outs, because it’s often the best they can realistically hope for. However the world is shifting and as time passes more and more of this sort of historical stuff, across society, is going to come out of the woodwork. Now victims are starting to get believed and at least they might start thinking they have a fighting chance for justice.

I fear this is the tip of the iceberg.

I didn't say the police never lie. Now you're putting words in my mouth.

However you seem to be taking the stance that female accusers never lie which is ridiculous.

The difference here is that the female accuser had financial incentive to lie.

This case is different because of the financial incentive for the accuser to make the allegations. I'm not suggesting that her allegations are completely false but there is a higher probability here of false allegations because of those financial incentives.

Well you can’t prove that and the majority of the time it isn’t like that.

100% Correct. Building on this, a "yes" can be rescinded at any point as well. You can feel comfortable with something and then say no 15 minutes later. At that point both the other party needs to stop whatever they are doing.

I feel like this is something a lot of people in this thread don't comprehend.

Also, without her consent, it is 100% rape regardless of whether they got forceful or rough.

When others enter the room, consent ends. It would have to be re established.

Even if it is re-established, as soon as it changed to forceful, consen . . . wait, if one is forcing someone to have sex, it is 100% rape.

When it changes from loving sweet gentle caresses to ride 'em cowboy rough, consent must be re-established.

And consent can be withdrawn at any time, without giving any reason.

And when I say consent, I mean consent when they are not incapacitated or under duress, like having a half dozen far physically stronger people unexpectedly surrounding you with clubs at hand and making you feel uncomfortable.
