I'm not sure when you think Joel Quenneville sexually assaulted someone, or how that is relevant. ...or why you think a vague statement of privacy laws in Canada applies to Columbus when it is not in the CBA. Either way...I think we've run our course.

It does.

I didn't want to get into a legal discussion with you - but I guess I need to.

Here:

There is no explicit mention of privacy in the U.S. Constitution, but in his dissent in Gilbert v. Minnesota (1920), Justice Louis D. Brandeis nonetheless stated that the First Amendment protected the privacy of the home. In Griswold v. Connecticut (1965), Justice William O. Douglas placed a right to privacy in a “penumbra” cast by the First, Third, Fourth, Fifth, and Ninth Amendments.

Do you believe the NHL CBA takes precedence over the 1st amendment right to privacy? It does not.

This is probably getting lost in all of this, but I wonder if CBJ has an out not to pay him here? If the NHLPA found some seriously egregious dirt on the part of Babcock, I'm wondering if they have a way to backout of paying him with some sort of morality clause or something along those lines? Also wondering if him "resigning" makes a difference versus getting fired in that regard?

I'm not well versed in legalese or the CBA, but this isn't the traditional situation where a coach is let go due to poor results and track record.
They would. Every contract has those clauses. We can probably assume though, they negotiated a buyout of some sort. Especially with their statement saying they agree, he is now in a position where he’s more of a distraction, etc, but admit no guilt.

The NHLPA is still going to have to react here btw. They now have 3 players, if we assume Babcock is guilty, that lied, or will now be seen as liars and their reputations will suffer.

Personally, I would’ve never hired him because frankly some of the things he’s done over the years to good people, just weigh too much. He was just a cold man. That said, we still don’t know if the allegations are true. The Jackets and NHLPA still need to clean this up, for the sake of everyone still involved.

If the NHLPA found nothing and Babcock resigned because he feels he can no longer coach the team because he’d be a distraction, then the NHLPA owes it to those 3 players to announce they found nothing.

All the fans who’ve just been hoping this got Babcock fired, probably didn’t think of the turmoil it will now cause. If it’s not true, it’s already cost a coach his job.

Without the NHLPA announcing they found nothing, Jenner can’t be captain of that team now. Werenski and Johnny G both have their reputations hurt too. Not to mention the GM and President. If the accusations were true, they now have to go too because they forced out that statement. Jenner also has to go if that’s the case.

This isn’t over yet. It probably put a period on Babcock’s career and honestly, nobody’s going to miss him, but there’s 3 players who’s reputations are now on the line. More with other players than with the public btw. If you’re a young player, you’re not going through a wall for Jenner now. Not if you believe he tried covering for Babcock. Whether it leads to Jenner demanding a trade or not, we’ll see, but he’s obviously not in a great position right now.

It’s a mess. If the NHLPA runs from it, those 3 players end up in a bad spot in their own locker room.

It wasn't literal, as it was hypothetical. Sorry that you think weed is the issue there. The car was the point, and, as a business owner, I'd fire anyone who invaded my employees property. Hell, I even tell clients to f off if they don't respect the people who work for me.
It all comes down to, if I don't want somone touching my car, my phone or whatever, I don't let them. If whoever thought Babcock was invading their privacy, tell him to kick rocks.

It's incredible that this douche bag had to wait 4 years to get a job once again and didn't learn a single thing.

I honestly think it means the leafs were refusing to allow him to be interviewed

When a coach is "fired" they aren't really fired, they are relieved of duty but are still under contract until it's up. Babcock signed with blue jackets the moment his contract with the Leafs expired.

So there may be a whole lot more to this story that we aren't aware of

Young players now know how to get the coach fired, just say that he did something that made you feel uncomfortable and voila, you got rid of the coach, but players can do pretty much whatever they want off the ice and it's all good. It's all about feelings nowadays, don't invade my personal space it makes me feel uncomfortable  And one last thing Mike please stay away from hockey brother you don't need the stress you have plenty of money go fishing enjoy life. Good luck to you.

A phone is personal property. Your employer can't just intimidate you into allowing them access to your personal property and you making this about "feelings" is out of touch. Guys might have personal/sensitive information on their personal property and if they don't let their boss see that information (or if they do) it could have a negative impact on their career. In what world is that okay? My boss can't just walk into my house and start rummaging through my things because they want to get to know me. They get to know what I want them to and they aren't entitled to anything else without a search warrant.

Hey Folks,

Going to ask if you can please refrain from the political discussions. Talk about Babcock and what happened to your heart’s content but please leave out the political and social issue discussions.

Thank You.

Being professionally toxic is WAY worse than cancel culture.

How the hell do you expect people to advance into roles with enough experience to manage?

Thinking you’re not approaching this accurately.

Take some time from the side of the internet that works to dumb you down.
I'm enjoying this, I don't want to step away

Think it's possible the situation with Jenner happened organically and the outcome was positive so Babcock being the maniac that he is thought this one size approach would fit all. Rigid, like his coaching style.

He's definitely a weird guy, but I do think there was some players on CBJ who had no interest in playing for Babcock and were waiting on him to make a mistake so he could be pushed out.

He waited 4 years because MLSE paid him what, $5m for 8 years.....then fired his ass for making Marner make a list of who are the laziest players on the team (and Marner put himself as the laziest apparently)

Then he f'd off back to Saskatoon because if he took another NHL gig, well he is no longer getting the big bucks from MLSE............

Dude comes back............gets outed for being a freakin' weirdo, resigns.

Buh bye. Cancelled himself......

Yes, but as Backcock's boss, as he's managing the players, particularly younger guys who haven't made the team, it's your job to tell him to kick rocks and, hopefully, screen for that with your next hire.

Then there it is. The changes in Columbus aren’t done. The locker room is going to be a mess with Jenner especially now. Management needs to go too, for forcing out that statement. Unfortunately Jenner, Werenski and Johnny G, will now lose tons of respect in the room.

did you literally google "First Amendment Privacy" and take the second result and offer it up as a legal argument?

sorry, I know I said I was out before... but I can't anymore. you probably shouldn't either.

That's exactly what I did, because you couldn't bother to. There was thousands of pages that contradicted you - but I decided to choose the first one to show how easy it is to realize your errors.

You seem to think NHL players are not entitled to privacy. It baffles me in what world you think that.

You: They don't deserve that - because it doesn't say it in the CBA!

You're right. Babcock choose to resign and the NHLPA is lying about it's statement. You got us. :sarcasm:

Gotta keep those toxic agendas alive apparently. LOL

Given that Babcock’s out, I wish ya luck - maybe the concept of an “incompatible operational procedure” dawns in time to demonstrate decency/understanding.

Not disagreeing with this whatsoever.
The point being, it's not sensitivity but power. Dumb analogy, but most of the people who work for me aren't in a place to tell others to kick rocks as, in their mind, they just need the job and money. As their employer, it's my job to do so for them when they aren't being treated right. We aren't hunter gatherers.

This exactly what I think happened. This seems like such a mountain of a molehole. But it's 2023 where whiners get their way when things get blown outta proportion
