Just watched that video and he used his leg in a whip fashion that had elements of the Johnson incident. Yeah now that I saw this incident I am more confident in my original position.
Shocking you found more "evidence" to support your foregone conclusion.

can someone post the video so we can judge if there was an intentional kick or not?

It's not hard to find if you search for it. It's of very poor quality though.

Which is why it's frightening how many people think they can tell for certain more than the players that were close to the incident.

Hey I just had one more point to make.

People have mentioned that Petgrave has a history of using or retaliating with his skates. I don't know that to be true myself, but I'm assuming that it is.

There is nothing wrong with you and I using that as part of our own assessment, but if this matter ever goes to court the Crown can not present that kind of evidence. Someone can have a criminal record a mile long, but that can't be rpesented in court until after the Accused has been found guilty.

For a criminal conviction, it needs to be “beyond a reasonable doubt”, not simply “more likely than not”

I’m of the opinion that sticking his leg up high was more likely than not intentional, but I can’t say it “beyond a reasonable doubt”

In a criminal trial, each side would be able to call up 10 different experts that would be able to say “it was intentional” or “it was not intentional” and I can’t imagine a jury feeling confident enough that it was intentional to convict.

I'm not a laywer but common sense tells me the bar you'd need to get to have him tried and ultimately convicted on manslaughter is not so much "he stuck his leg out high on purpose" it's closer to "he stuck his leg out high on purpose to try and kick him with the skate blade".

If you think the former might hard to prove, the latter would be that much more difficult

Need more details, but on the surface, that's not a good thing, arresting people for sports accidents, unless there's video of the guy intentionally kicking at Johnson.......
There literally is. The guy charged with manslaughter’s legs didn’t just magically fly in the air to deliver a B. Brian Blair drop kick to the neck

Missing a hit and throwing out your skate isn't relevant here? Isn't this exactly what killed Johnson? He 'missed' his original check and threw out his skates. Nobody in the history of hockey has avoided a hit by throwing an Owen Hart Spin Wheel kick.

It is freely available. And who decides how things work? You? LOL.

In wrestling terms, it was closer to a superkick since he kicks Johnson with his lead leg without a twisting motion. He's looking at him the entire time and kicks his leg out to slow or stop Johnson's cut to the middle.
