So right now, the NHL technically has 33 franchises, but will be icing 32 teams. The Coyotes are just dormant/inactive, but the franchise retained all branding, intellectual property, business ops, etc. If Meruelo is able to win the land auction and successfully meet the NHL's 5-year construction and hiring timeline (as well as meet their standards) then the Coyotes will become active again and they will probably have an expansion draft to get them players.
The land auction is taking place on June 27th.
It was all a bit weird, but my understanding was that yes, the Yotes owner doesn't want to stop being an NHL owner (and possibly needs the team to support his land buying ideas, and to run a sportsbook in AZ), however the NHL finally put their foot down about playing in Mullet.
