The intent was malicious, it was not an accident, he was pissed off and his temper got the best of him. You can't swing a club at someone's face, that's where his intent was malicious.
And I think Shanny will agree to some extent. Dangerous move, whether he apologized or not. What if that stick moved up and caught his eye?
