The driver isn't getting drunk genius

Therefore the open container doesn't matter

To comply with Section 154, Georgia's open container law must prohibit both possession and consumption of any alcoholic beverage container within the passenger area of any motor vehicle, including the unlocked glove compartment and any area readily accessible by the driver or passengers while seated.

Have you ever seen a guy drink in the back seat of his buddy's car

Who cares

He's not driving therefore it is legal period

"Only the person possessing the open container will be charged with a violation, but if there are no passengers, the driver alone will be charged."

Okay, I agree, the driver is a jerk.

Maybe he doesn't want to be an illegal rolling saloon.

If you can't put a beer down at 1130am when you've been drinking since 830am for a simple taxi ride and get your panties in a wad when the owner of the taxi won't let you consume it in his property, you seriously have a drinking problem and a serious lack of respect for others property.

I had one beer you jabroni. And then went for a swim after it.

Open Container Laws. Most states have laws prohibiting the presence of open cans, bottles, or other unsealed containers of alcoholic beverages (even if empty) on sidewalks, streets, and inside vehicles. So by default, a passenger drinking an alcoholic beverage also is in possession of an open container.

Just because people get away worth it doesn't make it legal.

Tell me what danger a guy drinking in the back poses to society

I don't know, distraction to the driver? I didn't make the law, but since it's a law in most states I'll assume there's a good reason.

You've been drinking the same beer you snapped me since 830 this morning?

Are you stupid?

I had a beer after work. Then went for a swim, took Joe to in laws, and went to store. I haven't been drinking non stop since 8:30 you clown. I had two sips of the one beer and then dumped it. And haven't had anything since.

If you are driving in Alaska, Connecticut, Delaware, Missouri, Mississippi, Rhode Island, Tennessee, and Virginia, it is not illegal for passengers to drink freely from open containers of alcohol (In Mississippi, the driver is also free to imbibe while driving as long as the driver's .BAC remains below .08%.)

By the letter of the law a tailgate for the football game at Ralph Wilson violates open container laws. Can't get drunk in public!

So you had two beers, or 2 sips of one beer? I'm pretty sure you snapped me 2 beers today.

And no I'm not stupid, I don't condone drinking and driving.

I had one full beer, a very weak one at that. And two sips of the second one.

And that's neat.

I wasn't drinking and driving.
