You miss-read my statement unless there are jails in hell.

They will have a fair chance to plead their case but there are public facts that are indisputable. There are three defense strategies:

1) One defendant can turn on the others claiming they really were not involved.

2) They could argue that the taped consent to the acts were valid…. There is case law the would quash that as consent after the fact is invalid and there really is no such thing as implied consent especially in the context of a group sex act that would absolutely require a clear affirmation of consent by all parties prior to the act.

3) They could attempt to disparage the character of the plaintiff, this is a risky strategy as attacking a rape victim usually makes the sentencing more severe by traumatizing the victim again through the hearing

You may defend them, and I know there are people that are wrongfully accused. in this case we are not disputing that those involved where there and committed acts that where far from normally accepted behaviour.

Is it a crime?, there is a very high likelihood or the crown would not pursue prosecution.
