Tavares’ Tax Battle: The Crux of the Dispute

In July 2018, John Tavares signed a lucrative seven-year, $77 million contract with the Maple Leafs, which included a hefty $15.3 million signing bonus. Tavares’ legal team argues that due to his U.S. residency at the time of signing—stemming from his nine-year tenure with the New York Islanders—his bonus should be taxed at only 15% under the Canada-U.S. Tax Treaty. However, the CRA contends that the bonus is not truly a bonus but regular income, subject to a higher tax rate exceeding 50%, due to attached conditions such as repayment if Tavares retired early.

Yeah this is not good news. And at first blush, it seems that the CRA has a valid point.

How does the CRA determine a signing bonus paid while JT is living in New York… is not a signing bonus?
This is what caught my eye - "attached conditions such as repayment if Tavares retired early." That doesn't sound like a bonus to me.

That's me though and to be clear, I'm not a tax expert by any means so my opinion of course means nothing. :)

IMO, still a bonus… John, we’ll give you a 15 million dollar bonus if you move back to Canada next season and sign a 7 year deal with Toronto.

If you don’t fulfill the whole 7 years and retire early… ya gotta pay back the bonus we gave you in New York.

The CRA is grasping like the greedy pricks they are.

I hope you're right, but it seems fishy to me. I believe it was announced as a signing bonus, he can't "unsign" so if they can ask for the money back, that indicates that it wasn't a signing bonus and if they're calling the bonus something that it isn't, that makes it seem like they're trying to get away with something.

Pierre LeBrun: Another piece of business for the Maple Leafs, of course, is the ongoing dialogue between the Leafs and their former captain John Tavares, who is a pending unrestricted free agent on July 1.

I don’t think anything is imminent at this point. I think part of that ongoing dialogue is that both sides want to see where the salary cap is headed.

We were at the Board of Governors meetings last week with Gino and we know there’s two possibilities. [The cap will rise to] $92.5 million next year or it will rise to a higher cap, and every dime counts for the Maple Leafs.

Contract comparables that I know have been talked about are [Ottawa Senators forward] Claude Giroux, who has a three-year, $19.5 million deal that he signed in July of 2022 and [Los Angeles Kings captain] Anze Kopitar, who signed a two-year extension at $7 million a year.

Those are contracts that I think are in the ballpark of what Tavares and the Leafs are talking about.


However, one contract that I don’t think Tavares’ camp has brought up was Steven Stamkos at four years, $8 million a year. I think that Tavares aims to be lower than that if this gets done with Toronto at some point.

They want to be fair and remain a Maple Leaf so both sides, mutually, would like to get something done at some point before July 1.

Regular season hockey is NOT playoff hockey .. guys unfortunately get paid on regular season stats .. JT can't keep up to playoff hockey .. he has got a bit faster this year but this is pre XMS hockey .. I'd wait to see how he does at end of season hockey .. in fact I'd wait til playoffs are over before getting serious about a contract .. my gut says he will look very slow again as we get into March as game pace picks up .. anything over $3M per longer term and I would pass .. even if it means going longer term .. sure you can move him to LW to extend his term
