Did he hit his helmet? It looks like it form video, but hard to say for sure. Couple thoughts:
1. If he hit his helmet, it 100% should still be a penalty. Glad it didn't hit him/player wasn't hurt, but it's still high sticking contact that should be penalized.
2. I wouldn't have minded if it was a penalty still, even if there's no helmet contact. You should be penalizing the action, not necessarily the result. Extreme example - player 1 gets pissed off, grabs his stick with both hands and take a baseball bat style swing at another player's head....but misses. Shouldn't he still be penalized for the action, despite no contact? Same idea here - the player raised his stick high very close to a player's face.
I think it’s easier to police result than intention for the vast majority of infractions.
