Did he hit his helmet? It looks like it form video, but hard to say for sure. Couple thoughts:

1. If he hit his helmet, it 100% should still be a penalty. Glad it didn't hit him/player wasn't hurt, but it's still high sticking contact that should be penalized.

2. I wouldn't have minded if it was a penalty still, even if there's no helmet contact. You should be penalizing the action, not necessarily the result. Extreme example - player 1 gets pissed off, grabs his stick with both hands and take a baseball bat style swing at another player's head....but misses. Shouldn't he still be penalized for the action, despite no contact? Same idea here - the player raised his stick high very close to a player's face.

I think it’s easier to police result than intention for the vast majority of infractions.

We passed on Kopitar and Ive always liked him. I'm supposed to keep pumping Brian Lee because we picked him instead? Lol

Are you comparing a legal stick lift play to a baseball bat swing at somebody?
No, it shouldn't be a high sticking call if contact wasn't made. Just because you missed the stick lift doesn't mean you tried to whack the player in the face. Yes, if you swing with intent to hurt/hit somebody and you miss, the intent is still there for a penalty. But you took this and went to the extreme.
 
Well that sucks, whether it is Keith, Matthew or Brady I always take comfort in despising the Tkachuks. Brady does something like this all I can think of is how Don Cherry probably would have loved this and had it on Coach's Corner praising Brady for his honesty. So yeah, good move by Tkachuk, not like we don't see a ton of embellishments out there. I have to say though did that really not hit him? It looked like it did, but maybe it missed him.

It obviously was a reaction. If a stick comes flying into the area of your face you are going to flinch. You aren't robotic.
