I actually would agree with someone intentionally wielding a stick as a weapon. I don’t that’s what we’re talking about though.
 
If Dahlin boards someone in a reckless manner and against the rules, and they get paralyzed, should he be charged.

If Tage recklessly high sticks someone, and they are blinded, should he be charged.

If Drai’s dirty ass cross check resulted in an injury, should he be charged.

In improper helmet to helmet hit in football?


Of course not. A very reckless kick shouldn’t result in a crime because of this freak result. It crosses a line we don’t cross, plays on the field (no matter how reckless or improper) aren’t crimes and everyone on the ice or field assumes that risk
We have already said something reckless in sports can be criminally charged. Look at McSorely on Brashear.

It is a reckless stick. Looks intentional.If something horrible happened to that player .. a charge is possible.

That's because you don't think the kick was intentional. I do and I don't think people would say that is a "normal hockey play"

It depends on each jurisdiction as to what it deems inappropriate. Not all states license boxing or MMA. That there are penalties is an acknowledgement that some conduct is not acceptable. If grievous harm results there is a possibility the authorities that sanction the activity might decide to intervene. Assumption of the risk has its limits. Again I do not think what happen was anything other than a tragedy.

But that wasn’t reckless, that was outside a sports play and was an attack on someone. Same with myles garret ripping off a helmet and hitting someone with it.

These others plays are reckless sports plays. While dangerous, they are still within the scopes of a sports play and resemble things you’ll see in the sport throughout the year

I do not put a deliberate kick to a player within the scope of a hockey play.. in fact the only time I recall seeing plays like this was by the same individual.

There's also the factor of this not happening before. It needs to go to court to decide if it is legal or not.

It will be hard to prove in court that it was a deliberate action.

I'm not sure about how UK laws and the legal process differs from the US. But, I was on a jury for a trial that involved a charge of first degree murder due to depraved indifference to human life. Proving reckless behavior and intent beyond a reasonable doubt is not a simple task.

And this is far from the first helicopter hit that leads to a skate flying around.

Most people think he was trying to kick the guy he killed with his skate, his lawyers will have to be very careful with jury selection.

There is no jury selection in England. 12 jurors are randomly selected.

Dunleavy often forgets there is a radio audience and just babbles without giving any reference to where the play is and then let’s out a “scores” wo telling you which team. Unlistenable.
Going from RJ to Dunleavy was like when Alex Ferguson retired as United manager and was replaced by David Moyes.
