It's possible that the Melnyk trust represented to him that there wasn't an open investigation, and it turned out there was, but even if that were true, his recourse is against the Melynk trust, not the NHL.
I agree, it certainly sounds like Andlauer and team were not aware of this throughout the purchase process. And its a very important bit of information that should have been brought forward. The NHL may not have been forthcoming. This certainly would be a key piece in the negotiation process and would have affected the purchase price. It equates to buying a building that has a lingering foundation problem that was not made knowledgable in the buying process, only to find out later that there were inspections going on with a possible foundation problem, but no one talked about it. The NHL is the one that decided the penalty and the investigation was active during the buying process. The NHL is definitely one of the parties that should be sharing any info they have with Andluer during the buying process.
The only reason Andluer wouldn't sue is to avoid creating headlines and staying in good graces with Bettman and Co. but in my opinion he should absolutely go after them for this. IF it is true that no one told him or warned him this could happen during the buying process.

Why was the verdict not made prior to the sale, the NHL took 18 months to figure this out, and decided that they were only ready to announce it thirty days after the sale.
It's not like this is a court of law were you can taint the jury pool, the investigation process would have been fully completed, the NHL could easily disclose the range of potential punishments being considered as well as the factual findings to all the potential buyers, but it sounds like they didn't.
Just forfeit it and tell the team the 2026 first rounder will be used to make the team better at the next deadline.
