North America's oldest professional sports trophy; 10th oldest sports trophy in the world (where mostly commonwealth countries hold the places). I take it back what I said in another thread that they should change the name. This is quite something (though I'm sure many of you knew this factoid).

This is just pure nitpicking for the sake of nitpicking, but the season started in January so it was just the 1893 season, not 1892-93.
Valid nitpicking!

It's like when people talk about the 2020-21 season. There was no such season, it was just 2021.

I believe the same can be said for 1995 and 2013...

The Coyotes were charging my credit card for my season tickets in the fall of 2012 though... :sarcasm:

When the lockout was officially announced, they did stop charging me, and when the 48-game season was ultimately decided upon, I paid the remaining balance for my account and that was that.

Every time I see trivia like this, I always wonder: why can't I just take the Stanley Cup and keep it? Pretty sure the NHL still doesn't own it. I've actually had it in my hands (one of the white glove guys used to live near me, maybe still does).

"While the NHL has maintained control over the trophy itself and its associated trademarks, the NHL does not actually own the trophy but uses it by agreement with the two Canadian trustees of the cup"

Seems almost like a public domain situation.

Because there are trustees… by definition that means it’s not public domain.

It’s like if you gave all your money to a trustee with specific legal instructions for how to use it, that specifically means they couldn’t just give it away.

NHL has a hard enough time marketing itself and you wanted to rename the trophy that is the most recognizable thing about the league?

They are trustees appointed by the NHL to take care of it for them. But if they don't legally own it, what does that mean? And I never said they'd give it to me, I'm talking about taking it. Nothing could have stopped me when I had my hands on it.

According to what I've read, in the event of a vacancy, the remaining trustee names the replacement for the deceased or resigned trustee, not the NHL.

No, you’ve got this part backward. The Trustees have appointed care/custody of the Cup to the NHL. The Trustees are legally separate from the NHL. The NHL only has possession of the Cup because the Trustees have allowed them an exclusive right to do so since the 1940s.

You may be thinking of the “keepers of the Cup” who travel around with it. Those are NHL employees with no particular legal right to the Cup.

But if they don't legally own it, what does that mean?

We’d have to look at the trust paperwork to be sure, but I’m fairly certain that legal ownership of the Cup devolves to the Trustees.

And I never said they'd give it to me, I'm talking about taking it. Nothing could have stopped me when I had my hands on it.

Well yeah, you can steal anything if you just run away with it. That doesn’t make it legal to do so.

You're right, I didn't understand what you meant. Interesting actually.

Well the NHL has effective control of who the trustees are. Basically it is a life appointment (though technically a trustee can resign) and the other trustee names a new trustee upon a death. The two trustees are former vice-presidents of the NHL.

Anybody have the link to the OP's post where he wanted to rename the cup. I want to read the replies.

Effective control, yes, but the question was about legal control.
