Do you have proof? That would seem to contradict the CBA...
"9.4. Minor League Compensation. Each Player Contract entered

As far as I understand if he'd have to be 25 or older to not fit into the entry level system.
"9.1. Applicability and Duration. Effective with contracts
entered into after the date of the 1995 Entry Draft:
(a) No Club may enter into a Player Contract with a Rookie
(excluding a player who is age 25 or older) that provides for
Compensation in excess of that permitted by this Article."
