Well this should wrap up now one way or the other. One petition drive fell flat. The second was rejected and the court backed up the rejection. All thats left if for Jamison to close or not.

Once he does of course we to see if Goldwater files an injunction against the lease when its finally in place.

They have a right to an appeal. Re: GWI, I do not see them seeking to enjoin the performance of a signed lease agreement. Problems with that strategy are too many to count. Don't hold your breath about the Gift Clause challenge. One thing the GWI is good at is factoring in the PR benefits and when its a lost return. I think they have played this as far as they intend. Bigger fish to fry with affordable health care and what not.

Is he a silent but get 'er done type? I tend to think those who stay behind the scenes are the ones who usually have their ducks in a row.

That said, things change when (multiple) investors are involved.

That's all I was wondering. If they have the support of businesses, they most likely have the dough to perfect, that is, if they file a notice of appeal.

I wasn't sure if the order was appealable as of right or if they needed some venue with which they needed to obtain leave.

Here in NY, you can appeal almost any order as of right to the intermediate court, but need to obtain leave to appeal to the court of appeals (court of last resort). Strange thing is our trial courts are "Supreme Courts"

If Jamison doesn't close this in "2 weeks", given that there is nothing standing in his way now, then he and the sale has all been a sham.

The funny thing is, after seeing the exact same thing already happen with IEH and Hulsizer, I'm not surprised in the least that Jamison doesn't have the money to purchase the team.

IIRC.... Sitren was emailing Tindall's office almost daily. GWI was angling to get directly involved in the negotiations back then.

Is that truly a lack of honesty and cooperation?? Or is it simply a case of "Lady.... quit harassing me and my staff. You'll get the documents for your review when they are complete and ready."

It has been a long time since the team had this much going for it...

A long playoff run.
All the other teams in Phoenix are not doing as well.
A large long term income stream from Glendale is there for the taking.
The NHL has their back.
A new CBA will be in place to better help the Have-Not NHL teams.
An NHL Insider (supposedly) has 88% of the financing needed to buy the team.


It is now or never. I hope the JIG steps up and puts this to rest.

So a $20 million shortfall in purchase equals how big a shortfall in covering operating losses that in a good year are probably $10-20 million?

Let them appeal. I hope they have the same legal team that advised them on how to incorrectly petition and challenge in court. The appeal will be strike 3, might as well, it is an hourly job. I agree, GWI in a nutshell...this cow is out of milk...

The CoG plan was to never release required documentation, hence the court case between the GWI and the CoG. They have been trying to make a deal under the cover of darkness since the beginning. I don't think anyone can make the argument that the CoG has been upfront and open in regards to the Coyotes sale.

In looking back, the CoG IMO knew that they were always at risk of violating the gift clause regardless as to who they were negotiating a deal with and the deal that they had to make to keep the team. Nothing wrong with that, but maybe if the CoG had been talking with the GWI from the start and asking the question " what would it take to make this satisfactory to the GWI " instead of just looking at them as something in the way, this team might already have a new owner. IIRC Hulsizer in the Cupcake meeting said that he was willing to sit down with the GWI to work through the issues, but by that point the CoG wanted nothing to do with the GWI. The animosity was just to great by that time.

Up until now, just by talking, the GWI actually has saved the Coyotes from being bought, not once but twice, from wannabe scam artists. I understand peoples thoughts towards the GWI, but if there was no GWI, IEH or Hulsizer would be the owner right now. You couldn't have wished a worse fate on the Coyotes faithful if either one of those jokes has somehow bought the team. Jamison at least has hockey knowledge and is the best potential for turning this team around.

I think the Huffing and Puffing will result in Nuffing (see Nothing :)) this time around.

I really do believe the JIG will own the team by the beginning of the season. Momentum is on their side.
All good things must come to an end. Even this.
