Wouldn’t he still likely get charged with vehicular manslaughter at the very least? He illegally passed the first vehicle going over the double yellow line into the oncoming lane and then tried to go around the second vehicle on the shoulder when he struck them from what I understand. This guy is a real piece of shit

The defense attorney is doing their job and throwing shit at the wall to see if it sticks. But I'm pretty sure any judge/jury is going to laugh at that defense.

It's potentially mitigating, but I wouldn't think it's sufficient to fully exonerate him. The lawyers are asking for dismissal. I'd be shocked if that worked, though I could see the jury considering it in terms of some lesser charge and/or the judge taking it into account in sentencing.
