OT: MLB Discussion Thread Part III: Jeter announces retirement after 2014

Don't know, but I'm assuming if he gives it a go he thinks he has a chance.

I don't know the process of getting something overtuned, but I do know that this suspension is totally bogus and I can't fathom how anyone could possibily think he deserves more than 50 games.

The rules are what they are. They say 50 games on a first failed drug test. He never even failed a test. Everyone else suspended with A-rod was given 50 games, why does he deserve more?

I honestly can't even debate this stuff. Like, nothing has ever been clearer to me. I've never been so sure of myself, this entire thing is so unfair and designed to make A-Rod the scapegoat.

Its all common sense to me. No contest, no debate to be had in my mind. If it'll be overtuned, dont know. No idea how the process works but if they look at the rules of the MLB, I don't see how they can uphold this.

You're 100% correct.

There's no chance A-Rod gets it overturned though. Selig and the MLB's old guard successfully abused their power.

A-Rod agreed to arbitration by playing in the MLB. Arbitration exists so the courts are not utilized for matters better decided outside the court. A baseball suspension is a matter that is better decided outside the court.

By agreeing to arbitration, A-Rod has little to no chance of having the award reversed. It's almost impossible. He'd have to likely show that the arbitrator was biased or something. Even arbitration awards based on the misunderstanding of a contract (thus the award would be considered "wrong") are not overturned in court.

You can say all you want about how unfair it is. The arbitration award has maybe a 1% chance of being overturned. And I'm being generous.

I assume that A-Rod already spent somewhere in the 7 figures during the arbitration process. An actual trial would cost even more.
 
As per the Federal Arbitration Act, these are the reasons an arbitration award may be vacated or modified.
§ 10 provides some limited requirements for an award to be vacated:

(1) where the award was procured by corruption, fraud, or undue means;
(2) where there was evident partiality or corruption in the arbitrators, or either of them;
(3) where the arbitrators were guilty of misconduct in refusing to postpone the hearing, upon sufficient cause shown, or in refusing to hear evidence pertinent and material to the controversy; or of any other misbehavior by which the rights of any party have been prejudiced; or
(4) where the arbitrators exceeded their powers, or so imperfectly executed them that a mutual, final, and definite award upon the subject matter submitted was not made.

§11 provides for some limited modification of awards:

(a) Where there was an evident material miscalculation of figures or an evident material mistake in the description of any person, thing, or property referred to in the award.
(b) Where the arbitrators have awarded upon a matter not submitted to them, unless it is a matter not affecting the merits of the decision upon the matter submitted.
© Where the award is imperfect in matter of form not affecting the merits of the controversy.

The FAA governs this contract (and almost every other contract out there) since it involves some form of interstate commerce.

Doesn't sound promising for A-Rod.

Whole thing stinks so bad for me. I wouldn't be surprised if the arbitrator was corrupt, but I don't think that can be proven.

I've heard people say (radio hosts) that the arbitrator wouldn't want to "rock the boat" by altering MLB's suspension by that much. Doesn't sound like a fair process to me.
 
Rodriguez will move forward with the injunction but no way it does what he wants. He's done. Good riddance.

If the Yankees and Baseball have their way (and everything seems to be tilted in their favor) then his remaining contract will be voided at some point.

They'll probably just release him. They don't really have a case to void the contract. The union probably would take drastic legal action if they tried that.
 
Jeff Nelson was on MLB radio saying Arod was a turd when he was a rookie.

Has anybody confirmed if he has a portrait of himself as a centaur in his house?

A-Rod is awful, which makes it even worse that he's the figure I have to root for against the corrupt MLB.

we will see, if it goes federal and Arod gets his wish, all the evidence goes public and he would prob have to testify under oath if he gets it to that stage.. then what?
 
and actually Braun got more than 50 games and supposedly according to Manfred and Bosch who will be on 60 minutes tonight, they have more on Arod
 
Sports Hochi in Japan reports that the Yankees, Dodgers and Angels are the finalists to sign Masahiro Tanaka.It goes on to say that the Yankees are the favorites to land the right-hander.*The report is certainly worth passing along, but it should be taken with a big grain of salt. After all, remember that many Japanese news outlets reported that Tanaka wasn't coming to the states at all. His signing deadline is January 24
 
Frankly, I don't think A-Rod would have a chance in hell since he got more games for being a facilitator for other players for steroids and for obstructing. It's not just for the circumstantial evidence that he took the steroids.

Was he suspended under the steroid policy?

I don't believe he was therefore the 50 game penalty doesn't apply.
 
ARod laughs all the way to the bank.
He has 500 million reasons not to care what anybody thinks.
What is MLB gonna do? Sue him for fraud?
They profited just as much as he has.
 
Not sure why Grant Balfour isn't a Yankee by now. Especially with the ARod suspension.

Young or Reynolds for 3rd base. Tanaka. Johan Santana to a minor league deal. Done.
