Whenever Zacha is signed, however, it appears the Devils will have to pay a $100,000 transfer fee to his team in the Czech Republic for him to be eligible to play in the NHL in 2015-16.

As part of the agreement between the NHL and the European professional leagues, any 2015 draft pick that is under contract with a European club had to be signed by 5 p.m. on July 15 (Wednesday) to play in the NHL in the 2015-16 season. The NHL team can still extend the deadline until Aug. 15 by paying $100,000 directly to the European team that owns the player's rights.

This is where good old Loophole Lou needs to step in. If they say he has a contract and the Devils pay 100k i would SO try and fight that he was drafted out of that league and that he can jump right to the AHL by-passing the junior rules. No idea if it would stick but I would give it a try.

Worth a shot.

Didn't realize Zacha was only temporarily loaned to Sarnia last season. I had been scoping out their schedule just in case there was a chance to catch a game this fall, but I guess I'll scratch that off the list.

...that would be great to be saved if possible and applied elsewhere.

It's a drop in the bucket. Not worth "fighting" and creating headaches over.

It's less than 1/6 of the cheapest contract on the team. Who cares? It's not even a cap penalty. It's $100,000 cash to a club on a different continent.

Im not saying that they shouldnt pay the 100k.

Im saying they should argue that because he was "on loan" to the OHL that he was drafted out of that league by-passing the junior rules which would make him eligible to play in the AHL or NHL this season.

Even if the NHL says no its worth a try. I would obviously pay the 100k either way without question.

Shero isn't going to (and shouldn't) let that effect his decision making on Zacha, though.

Oh, obviously not.

and he's not going to either (from TG)

“I don't think it matters,” Shero said. “There's nothing that's going to stop us from signing Zacha. All I'll say is we're continuing to try to work on something with Pavel Zacha. If and when there is a deal that makes sense for both parties, we'll sign it. Our goal is to sign him, it always has been and it doesn't matter because it's all part of he bigger picture in terms of what's best for Pavel and the hockey team. It's the same thing about whether he's going to play on our team or not (in 2015-16). That's all.

“Any dates, don't even (matter),” Shero said. “We anticipate signing him. He's going to be part of the organization. There's nothing where we are now that we're not going to be able to sign the player that he can be eligible to play for the Devils this year if that's the best way to go. That's the main thing, so we'll see where that leads us and, hopefully, it leads us to a deal. He's been a pretty impressive kid in camp.”

I think you're right about that. If the Devils have to pay the Czech team, it's only fair that Zacha be treated as if he were drafted out of that league, and be eligible for the AHL if he doesn't fit in the NHL next season. Not fair if we have to pay a Czech team for him being under contract this season and send him back to juniors when he was apparently only on loan there for one year.

I think TG has things a little mixed up in his most recent post on the matter.

As part of the agreement between the NHL and the European professional leagues, any 2015 draft pick that is under contract with a European club had to be signed by 5 p.m. on July 15 (Wednesday) to play in the NHL in the 2015-16 season. In Zacha's case, that team is Liberec, for which he put up four goals and four assists in 38 games as a 16-year-old in 2013-14. Zacha played in the OHL for Sarnia in 2014-15 under a limited one-year release from his deal with Liberec.

Key parts being:
1) Zacha may still be under contract with his Czech team
2) Zacha was loaned to Sarnia for one year

Based on #2 alone, it sems Zacha is ineligible to even return to Sarnia and must either play in the AHL/NHL or go back to his Czech team. It is possible that if the Devils pay the 100k transfer fee (or if he's no longer under contract there), they can choose to return him to Sarnia.. but that would be their option at worst.

There was a similar situation last year with Julius Honka:
http://starsblog.dallasnews.com/2014/09/stars-reduce-roster-by-six.html/

Honka played last season with Swift Current of the WHL, and would typically have to return there under the agreement between the NHL and Major Junior hockey. However, he was on loan from Finland to the WHL, so he’s not allowed to go back to junior this year, according to Nill. That meant the choices for the Stars were to send him back to Finland or send him to the AHL. The Stars have decided to place the 18-year-old with the Texas Stars and leave him there for the season.

Seems to be the same situation.. not sure why it hasn't been reported as such though.

I think this is one instance where TG is absolutely wrong. This would make no sense.

Either he's still under contract with his Czech team, we owe them 100k but then we can do with him as we wish...

Or he's no longer under contract there and depending on the technicality of the loan (see above post), he may have to return to Sarnia.

There's no possibility of us owing 100k AND having to return him to Sarnia.

Thanks for clarifying. I get so baffled by all these rules. :help:

Interesting point. Albany might be a good place for him, too, depending on how he does in camp.

Looks like its been debated before.

Leads me to believe that if he is truly "On loan" then he would be eligible to play in the AHL this year if he doesnt make the NHL team.

2.1 billion according to Wikipedia. That's like a buck to guys like us

jeez. you know what that amount is worth then to someone worth 200k (which is still def a lot)? $9.50. i agree it's a waste of money but at least it's going to another hockey team to use as opposed to like money in the trash. i think we're fine though. the argument will either get us zacha faster, or we won't have to pay at all. eric sachs explained it quite well imo.
